I bought a dog from a breeder and when i got home i realized he was sick what can i do?


Ok after a long time of looking for a Pomeranian breeder in Florida I finally found one that looked good. When i got there I feel in love with a little white one. So i bought him for 750 and started going home. I got his health certificate saying he was healthy and worm free. On the way home I saw a tick in his ear. Then after we got home i realized that there was more ticks in his ears, he had tape worms and hook worms. When i called her she said oh yah it's Florida all dogs have ticks thats normal, I said no my other dog has never had them. My point is can I do anything to this lady for selling me a puppy with these issues? I have already taken him to the vet for all the issues

You bought from a back yard breeder, what do you expect? Florida law states that:

State animal dealer laws regulate not only day to day operations, but provide remedy to the consumer if it can be shown that the merchant sold a "defective" dog. Similarly, Courts have held that under certain circumstances, sale of a diseased puppy could be considered breach of express warranty either under a state uniform commercial code, or products liability law. The hope is that by holding the dealer responsible for the quality of their product and compensating the consumer where merchandise is "faulty," the distributor will be forced to pay greater attention to the health of the puppy. In turn, this heightened watchfulness can be expected to affect the choices made by distributors when purchasing puppies for resale, ultimately reducing the number of puppies purchased from puppy mills.

Also for each dog offered for sale within the state, each dog must receive vaccines and anthelmintics against the following diseases and internal parasites:

1. Distemper
2. Leptospirosis
3. Bordatella
4. Parainfluenza
5. Hepatitis
6. Canine Parvo
7. Rabies - Only over 3 months of age
8. Roundworms
9. Hookworms

Unless a vet specifies that it would not be in the best interest of the dog and states that on the Health Certificate those items must be done BEFORE a dog can be offered for sale. If the dog is under 4 months of age the above must be administered no more than 21 days before sale within the state.

Sounds like this backyard breeder doesn't know the laws and therefore her "Health Certificate" is bogus. I suggest you call Animal Control in your City and report the Breeder for selling unhealthy dogs. The ASPCA will investigate all her puppies and check health certificates on them.

Your rights for compensation under the Law is as follows:

(5) If, within 14 days following the sale by a pet dealer of an animal subject to this section, a licensed veterinarian of the consumer's choosing certifies that, at the time of the sale, the animal was unfit for purchase due to illness or disease, the presence of symptoms of a contagious or infectious disease, or the presence of internal or external parasites, excluding fleas and ticks; or if, within 1 year following the sale of an animal subject to this section, a licensed veterinarian of the consumer's choosing certifies such animal to be unfit for purchase due to a congenital or hereditary disorder which adversely affects the health of the animal; or if, within 1 year following the sale of an animal subject to this section, the breed, sex, or health of such animal is found to have been misrepresented to the consumer, the pet dealer shall afford the consumer the right to choose one of the following options:

(a) The right to return the animal and receive a refund of the purchase price, including the sales tax, and reimbursement for reasonable veterinary costs directly related to the veterinarian's examination and certification that the dog or cat is unfit for purchase pursuant to this section and directly related to necessary emergency services and treatment undertaken to relieve suffering;

(b) The right to return the animal and receive an exchange dog or cat of the consumer's choice of equivalent value, and reimbursement for reasonable veterinary costs directly related to the veterinarian's examination and certification that the dog or cat is unfit for purchase pursuant to this section and directly related to necessary emergency services and treatment undertaken to relieve suffering; or

(c) The right to retain the animal and receive reimbursement for reasonable veterinary costs for necessary services and treatment related to the attempt to cure or curing of the dog or cat.

Reimbursement for veterinary costs may not exceed the purchase price of the animal. The cost of veterinary services is reasonable if comparable to the cost of similar services rendered by other licensed veterinarians in proximity to the treating veterinarian and the services rendered are appropriate for the certification by the veterinarian.
