Puppy Seller won't accept my check payments. She wants puppy back. What can I do?
I bought a puppy from a breeder for total of $1200. I was to pay $150.00 upfront which was in May and we exchanged the $150.00 for the puppy in my state of Texas (we met). The additional amount is to be paid in full by Feb 12 2009. The seller agreed to do this for 2 reasons. 1. I did not have the money at the time due to my mothers funeral expense. 2. She had no buyers for the puppy and wanted to sell it b4 it got too big. The night b4 we met she told me someone called her and wanted the pup, but she would still go through with our agreement. She did, but when I voiced concerns to her about the puppies health she started hinting at wanting the puppy back and for us to drive it back to her in Lousiana. I refused and took care of the puppies problems and told her the pup was not a disposable piece of property , but our family member now. I have sent her payments and she won't cash checks. If payments isn't received by 2/2009 she doesn't have to send me the AKC papers and she wants pup.
Ok folks, have we learned our lesson about buying dogs sight unseen and without contracts? Reputable breeders will have you over to their home to see the parents and their place. they will also have a contract. The contract should have a clause in it allowing you to have the dog vet checked and listing your options of recourse if the dog is not healthy. Each state has different laws about recourse in these situations. It does sound like you have the upper hand since she delivered the pup and you have delivered payments as agreed. I would do some research about TX law and like everyone else said, document everything since you may end up in court.
Also it would be a good idea to post this question in the legal section.

Buying a puppy from another state?
My sister wants to buy a yorkiepoo and found one you like, but it is in Texas and Ohio in which we live and we are not going to drive so far just a puppy. The breeder is sell the dog kind of cheap as the cost of shipping. $ 200 for the dog $ 156 for shipping. I read a lot about scams, but emails he has had with the breeder does not seem like I've seen, but what seems to have broken ... English. He answered all the questions from my sister in an honest guy so as my question is what to avoid being tricked are you supposed to pay half upfront and half after getting the puppy? I do not want to get ripped off and dissappointed another reason is supposed to be cheap is because a puppy is not registered. But my sister has only seen a photo of the puppy he wants for himself and another with his two sisters
WARNING !!!!!!!!! CARE !!!!!!!!! I would not. I bet you anything you can find one near you. First Instead, it will cost more than $ 156.00 to ship to you. Most airlines will cost at least $ 200.00. My sister breeds Cocker Spaniel in Wisconsin and she sells the country and when she sent me mine costs $ 250.00 on Delta. Secondly, you have no idea what conditions this puppy is in. You could get that could be deadly sick. As you know this could be a puppy mill. Does it come with a health guarantee? Does your money back if their is something wrong with the dog or going to another ship free? Is there a website where you can see the parents? All these are questions to be answered. I understand that your sister wants a puppy, but believe me it will be happier if a healthy one. Good luck.
